- WHAT TO KNOW ABOUT LAND TITLES IN NIGERIA!
Many new and even established investors in the real estate sector in Nigeria have had their fingers burnt from not having a good understanding of good land titles in Nigeria. You do not have to be one of them. Therefore, carefully read this post, to be well-equipped the next time you think of investing in real estate in Nigeria. We would begin by helping you to understand the importance and benefits of having a good land title. There are several reasons why you should go for a land with a good title: ✅ Legal Protection: A property with a good title, such as a Certificate of Occupancy or Governor's Consent, offers legal protection and certainty of ownership. It reduces the risk of disputes and ensures that your investment is secure. ✅ Marketability: Properties with good titles are more marketable and easier to sell in the future. Potential buyers will be more inclined to purchase a property with a clear and recognised title, which can lead to better resale value and faster transactions. ✅ Access to Financing: Lenders are more willing to provide financing for properties with good titles since they represent a lower risk. Having a recognized title increases your chances of obtaining a mortgage or other forms of financing, making it easier to purchase the property. ✅ Peace of Mind: Knowing that you have a property with a good title gives you peace of mind and confidence in your investment. You can rest assured that your ownership rights are legally protected, allowing you to enjoy your property without worrying about potential legal issues. ✅ Long-term Security: Investing in a property with a good title provides long-term security and stability for you and your family. It ensures that you have a tangible asset with clear ownership rights, which can be passed down to future generations or used as collateral for other investments. Overall, buying a property with a good title is a wise decision that offers numerous benefits, including legal protection, marketability, access to financing, peace of mind, and long-term security. It's an essential step in safeguarding your investment and building wealth through real estate. The top five land titles in order of importance are as follows: 1. Certificate of Occupancy (C of O): This is the highest form of land title in Nigeria. It is issued by state governments to individuals or organizations to certify their rights to land ownership. A C of O grants the holder exclusive rights to use and develop the land for a specified period, usually 99 years. 2. Governor's Consent: This is a formal approval obtained from the state governor for transactions involving land with an existing Certificate of Occupancy (C of O). It is required when the holder of a C of O wants to transfer or assign the land to another party. Without Governor's Consent, any transaction involving such land may be deemed invalid. 3. Right of Occupancy (R of O): This is a land title issued by state governments to individuals or organizations for the use of land for a specified purpose, typically agricultural, residential, or commercial purposes. Unlike the Certificate of Occupancy, the Right of Occupancy does not grant outright ownership but rather a right to use the land for a specified period, usually renewable. 4. Registered Conveyance: This refers to a document that transfers the legal title of land from one party to another. It must be registered at the appropriate land registry to be legally recognized. A registered conveyance provides evidence of ownership and helps to prevent disputes over land ownership. 5. Deed of Assignment: This is a legal document used to transfer ownership interest in land from one party (the assignor) to another (the assignee). It is commonly used in cases where the land has not yet been titled by the government. However, it is essential to register the deed at the appropriate land registry to protect the assignee's interest. It's important to note that the significance of each title may vary depending on the specific circumstances of the property transaction and the legal requirements of the relevant jurisdiction. Additionally, seeking professional legal advice is always recommended when dealing with property matters to ensure compliance with applicable laws and regulations.
